Even though there is no explicit law in New Jersey that states that hosting online casinos websites is a crime, the Supreme Court decided that it is unlawful and illegal and the host of these gambling sites can be punished by law.
The case concerns a 48 year old man, Nicholas Drakos, who hosted one of the many online casinos available on the net, from his own home in Belleville. To catch Drakos red handed, an undercover police officer set up an online casinos account at the site of Drakos, and in January 2004 they met in person to discuss the affiliate program of Drakos. To make it all seem as real as possible, the undercover agent recruited the "other bettors", who were also undercover agents. Nicholas Drakos was arrested at the Newark Liberty International on the first of April carrying over $1,500 in cash and his gambling records. He was officially charged with promoting gambling through an online casinos website, conspiracy to promote gambling and money laundering in the first 3 months of 2004.
The attorney of Drakos, Robert Dunn, tried to convince the Superior Court Judge Salem Vincent Ahto of Morristown to dismiss the charges of Drakos. He claimed that the state legislature never specified that hosting online casinos and any other form of online gambling is considered a crime. Dunn states that Drakos didn't know he was committing a crime hosting the online casinos website was illegal. Another argument of Dunn was that states like Wisconsin and Illinois have laws that specifically prohibit online casinos, but New Jersey has no such thing.
Prosecutor Melanie Smith contended that the state law of New Jersey states that everyone is guilty of promoting gambling when he or she engages knowingly in behavior that helps promoting gambling activities and therefore Drakos is guilty. The Superior Court judge added that even though online casinos and other forms of online gambling are not directly labeled as criminal activities, doesn't mean hosting online casinos is a lawful business. Despite the fact that judge Ahto did not dismiss the charges of Drakos he made clear that the state will still have to prove that Drakos actually promoted gambling through his online casinos website in trial, and Ahto pointed out that this won't be an easy task.
